Terms of Service

1. Agreement with us

By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms. If you are an individual consumer, you confirm that you are of legal age to enter into a contract.

2. The Service

QRPogo lets you create static and dynamic QR codes, customise their appearance, manage them in projects and workspaces, and view scan analytics for dynamic codes. Features and limits depend on the plan you subscribe to, as described on our pricing page.

3. Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• create QR codes that link to fraudulent, deceptive, hateful, sexually exploitative or harmful content, or use the Service for spam or phishing;
• infringe the intellectual property or other rights of others, including by encoding content you have no right to use;
• interfere with the security of the Service — including introducing malware, probing or scanning vulnerabilities, scraping at a scale that degrades the Service, or circumventing technical limits or access controls;
• resell or redistribute the Service, or provide it to third parties as a competing service, without our written permission.

4. Your account

You are responsible for keeping your credentials confidential and for all activity that happens under your account. You must provide accurate information and keep it up to date. Tell us promptly if you suspect unauthorised use of your account.

5. Payment and subscriptions

Paid plans are billed on a monthly or annual basis as shown at checkout. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payments, billing, taxes, cancellations and refunds for subscriptions are handled by Paddle and are subject to Paddle's Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms. Upgrades and plan changes take effect as described at checkout; downgrades take effect at your next renewal.

6. Your content and licences

You retain all rights to the content you create or upload to the Service (destinations, branding, QR code designs). You grant us a limited licence to host and process that content solely to provide the Service to you. You are responsible for having the necessary rights to the content you use and for the destinations your QR codes point to.

We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of your selected plan. You may not reverse engineer the Service, circumvent its technical limits, or use it other than as intended.

7. Intellectual property

Gifie Kft. retains all rights, title and interest in the Service, including the underlying software, documentation, design and the QRPogo branding. Nothing in these Terms transfers any ownership of the Service to you.

8. Service level and availability

We aim to keep the Service available and error-free, but we do not guarantee uninterrupted or error-free performance. The Service is provided “as is”, and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

9. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or repeatedly or seriously violate our policies. Where practical, we will give you notice and a chance to remedy the breach.

When your access ends, your QR codes stop redirecting and your data becomes unavailable. You can export your data before closing your account; after a reasonable grace period, remaining data is deleted in line with our Privacy Policy.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the six months before the event giving rise to the claim. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.

11. Indemnity

You agree to indemnify us against claims arising from your content, your use of the Service in violation of law, or your breach of these Terms.

12. General

• Changes: we may update these Terms; material changes will be announced in the Service or by email, and continued use after they take effect constitutes acceptance.
• Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
• Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
• Governing law: these Terms are governed by the laws of Hungary, without prejudice to mandatory consumer protections in your country of residence.
• Disputes: the courts of Hungary have jurisdiction, except that consumers may also bring proceedings in their country of residence where applicable law allows.
